An Overview of Filing a Rental Dispute Complaint at the Dubai Rental Dispute Centre

Rental disputes are among the ten most prevalent types of legal conflicts worldwide, notably in the United Arab Emirates. Low maintenance costs and high rental revenue are two of the most common causes of rental disputes. It is unlikely that a commoner could cope with such a situation due to several factors: the shifting economic climate in which we live. In these cases, it is essential to seek the advice of a legal advisor.

In the event of a rental disagreement, our law business provides the necessary assistance and direction by allowing well-experienced rental dispute lawyers in the UAE to handle the matter. To resolve rental issues or disputes, both tenants and landlords must clearly understand their responsibilities and rights.

Dubai Rental Disputes: When Should You File the Matter

There are times when contractual rights are violated even though the Dubai Land Department has put processes to help Tenants, landlords, purchasers, and sellers.

The first step is to consider finding a solution that benefits all parties concerned. However, there are situations when the landlord and renter have exhausted all avenues of conversation and reasoning. At this point, you’ll need to file a rental dispute case in Dubai with the Dubai Land Department (DLD).

The centre was formed to facilitate the resolution of conflicts between landlords and Tenants. The centre’s committee investigates all instances of disagreement except those concerning financial problems such as financing leasing contracts and rental disputes in free zones (JAFZA, Tecom, DMC). The most often filed complaint is against landlords for enforcing unreasonable rate increases in violation of Dubai’s Rental Increase Laws. However, landlords may sometimes be required to submit complaints against their Tenants.

Steps for Filing Rental Dispute at Rent Dispute Resolution Center

The Rent Dispute Resolution Center accepts cases from both tenants and landlords (RDC). Let’s look at how Tenants in Dubai might file a complaint with their landlord.

Keep in mind that the same procedures apply if a landlord needs outside assistance in resolving a disagreement with one or more of their tenants.

The first step is to get familiar with Dubai’s rental laws: The Dubai Tenancy Law should be read thoroughly before considering taking legal action in Dubai over a rental issue. As a result of this new legislation, rental agreements in Dubai are now subject to stringent regulations. The first step in resolving a disagreement is to get familiar with the RERA legislation, whether you’re a landlord or a renter. You can’t register a rent dispute in Dubai at the rental dispute centre based only on your assumptions. The best course of action is to consult with an attorney if you don’t know enough about the law to do it independently.

  • Informing the other party and working out an arrangement is the best course of action.

It is preferable to advise the opposing party of your legal position after knowing the legislation supporting your RERA complaint. For example, if you believe you’ve been overcharged for your rent, you should tell your landlord about the situation. Make careful to record all of your communications with the other person.

  • If you fail to negotiate, register your complaint with Dubai Rental Dispute Centre

If you have difficulty reaching an agreement with your landlord, you could register a formal complaint with the Dubai Rental Dispute Settlement Center. The Dubai Rental Dispute Center was created to guarantee that any conflicts between landlords and Tenants are settled efficiently. When a dispute is brought to the centre’s attention, the committee considers all aspects of the situation. However, it does not include cases involving financial problems, such as financing leasing contracts or disputes in free zones. Our skilled lawyers are here to assist you in filing complaints and seeking resolution, regardless of the nature of your disagreement.

  • Filing of Documents

When submitting a rental dispute, make sure you have originals and copies of the following documents:

  • Visa and passport of tenant
  • Emirates Identification Card
  • Certificate from Ejari
  • Original tenancy agreement in blue.
  • DEWA bills from the recent past
  • Deposit slip for a rental
  • Copies of cheques sent to the landlord
  • Landlord’s title deed and passport copy (originals necessary if you are the landlord)
  • Copies of any communication between the tenant and the landlord about the rental increase or the current conflict
  • Any additional documents that would be useful in proving your case

If you’re dealing with a commercial property, you’ll need all of the papers related to the company (trade licenses, etc.). It is unquestionably helpful if you have an Arabic copy of these papers. Once you’ve gathered your documents, go to the RDC’s typing centre to fill out your complaint, which will prepare you to submit your case. The typist will translate the required papers into Arabic and inquire about your disagreement’s basis to formalize your complaint correctly.
