Marriage law in UAE

Are interfaith marriages in the Emirate of Dubai legal?

The increasing population diversity in Dubai has made interfaith marriages between people of different religious backgrounds more prevalent. As a result, many residents in Dubai seek information about legal status and specific regulations of interfaith marriages according to UAE laws. This article provides all necessary information about interfaith marriage in Dubai for Muslims and non-Muslims alongside recent changes that improve marriage processes for many individuals.

What is Interfaith Marriage?

Interfaith marriages are those where two partners belong to different religions. For instance, one partner might be a Muslim while the other could be a Christian, or one might be a Hindu while the other could be a Jew. These marriages are also called mixed marriage or interreligious marriages.

In Dubai, interfaith marriages are permitted under certain conditions. Non-Muslim couples may marry via civil law, while Muslim couples must adhere to Islamic regulations. For instance, a Muslim man may marry a Christian or a Jewish woman; however, it does not allow a Muslim woman to marry a non-Muslim man without proof of his conversion to Islam.

Is interfaith marriage legal in Dubai?

Yes, interfaith marriages in Dubai remain legal but the marriage requirements differ based on religion and nationality status. The UAE operates two distinct marriage laws that govern couples from Muslim and non-Muslim backgrounds.

  1. Sharia Law – applies to Muslims.
  2. Civil Law for Non-Muslims – applies to non-Muslims from any nationality.

The UAE Personal Status Law (Federal Law No. 41 of 2024) applies to Muslims and is based on Islamic Sharia. Federal Decree Law No. 41 of 2022 established civil marriage for non-Muslims throughout the UAE who do not need to consider their religious procedures for marriage purposes.

Civil Marriage for Non-Muslims in Dubai

The UAE now permits civil marriage for non-Muslim couples through the implementation of Federal Decree Law No. 41 of 2022. Under this legal framework non-Muslim couples have the opportunity to get married through civil procedures which do not enforce religious requirements.

Key Conditions for Civil Marriage:

A Dubai resident who wishes to obtain civil marriage status must fulfill these requirements before submitting their application.

  • Both parties must be non-Muslims
  • At least one of the parties must be a resident of Dubai
  • The couple or their legally authorised representatives must appear in person
  • Original IDs are required to prove their identity details
  • Proof of being single must be provided.

Note:

  1. The documents must be submitted as soft copies in PDF format.
  2. For documents in a language other than Arabic, certified Arabic translations, stamped by Ministry of Justice in the UAE are required.
  3. Certification of documents from outside UAE must be done by Ministry of Foreign Affairs in the country of origin, the UAE embassy and Ministry of Foreign Affairs and International Cooperation of the UAE.

Non-Muslim residents of Dubai are allowed to avail a civil marriage service through the Dubai government’s new program. The service allows couples to obtain a civil wedding license within a 24-hour period.

Under this law couples who belong to different religious faiths can obtain legal marriage status without needing conversion or religious ceremonies.
