Case Study: Employment Rights Dispute Following Corporate Restructuring
The Challenge
My clients were a set of senior executives from an international company that had been fired after a business merger. My client insisted that the firm was restructuring and therefore there was no obligation to pay any bonuses or compensations according to the firm’s policy.
Strategic Approach
I did a thorough analysis of the entire merger process and analyzed the terms of employment contract. I drew from my legal background in human rights to counter the company’s claim that the firings were necessary as part of a restructuring process.
I made a well-substantiated claim to the labour courts, presenting substantial evidence, especially regarding poor performance and lack of statutory notice.
The Result
In the end, the court decision went in favour of my clients, who were granted full compensation for their termination, in addition to any pending bonuses or benefits owed to them.
This case clearly demonstrated the point that companies cannot restructure themselves to avoid compliance with UAE labour laws.
