What Is Power of Attorney?

The Power of Attorney (POA) is a legal document which enables an individual known as an agent or attorney-in-fact to perform actions on behalf of another individual. The POA document specifies the powers that the agent can use to perform certain activities which include selling property, handling bank transactions and representing the principal during court proceedings.

In the UAE, the POA document must meet the following requirements:

  • The document must be drafted in Arabic or bilingual (English and Arabic) with certified Arabic translation. In case of any discrepancy, the Arabic text prevails.
  • It must be certified and notarised by an authorised UAE Notary Public through Dubai Courts, the Ministry of Justice, or an approved enotary service.
  • The POA must include complete identification details for both the principal and the agent, including their full names, passport information and Emirates ID numbers.
  • The document must mention all the authority and power given to the agent.

What are the Types of Power of Attorney in UAE?

Understanding which type of Power of Attorney (POA) you need is very important. If you choose the wrong one, courts, banks, or government offices may reject it.

General Power of Attorney (GPOA):

This POA gives the agent powers to perform many tasks for the principal. This can include handling money, dealing with legal issues, using bank accounts, and talking to government offices.
However, a General POA is usually not accepted by the Dubai Land Department (DLD) for selling or transferring property — you must have a specific Special Property POA that clearly mentions the exact property and transaction.

Special Power of Attorney (SPOA):

This POA is limited to a particular or specific task such as selling a specific property, collecting a cheque, or representing the principal in a particular court case. Most UAE government offices, banks, and courts prefer SPAs because they are clear, limited, and low-risk.

Common Uses of POAs in Dubai

Apart from the above two types, there are many other common uses of POAs in Dubai, including:

How to Get a Power of Attorney in Dubai

As a licensed Private Notary Firm in Dubai, HHS Lawyers & Legal Consultants offers fast, simple and complete services to assist you with preparing and signing your Power of Attorney (POA) documents in Dubai. Our Team ensures that your POA document(s) are valid, accepted by all UAE Authorities including Dubai Courts, DLD, RTA and Banks etc.

Here is the easy digital POA process step by step we follow:

Step 1: Create the Document Simply

Our lawyers will draft a simple and clear POA document according to what type of POA you require (i.e. General or Special POA). The POA document drafted includes specific Powers (for example; “to purchase”, “to sell”, “to sign”, “to administer property”, or “to act in Court”).
We also include full details of both individuals (Principal and Agent), such as passport or ID numbers.
The POA is prepared in Arabic and English side-by-side. Our professional drafting makes sure everything is correct and accepted the first time as unclear wording can cause the POA to be rejected.

Step 2: Verify UAE Pass Account

The person making the POA must have a working UAE Pass account. This is the digital ID used to sign the POA.
If you live in the UAE and have an Emirates ID: We help you make sure your UAE Pass is active and in “Green” status (face/biometric check done).
If you are outside the UAE and don’t have an Emirates ID: We guide you on how to use the Non-Resident UAE Pass or how to do the process through the UAE embassy, depending on what fits your case.

Step 3: Online Submission

We upload your professionally prepared POA to the official Dubai Courts E Notary system or the Ministry of Justice system. We also upload all the documents needed, such as:

  • Passport and Emirates ID copies (for both the Principal and the Agent)
  • Proof of ownership (like a Title Deed for property POAs)
  • Any other documents required for your case

Our team handles the whole submission so there are no mistakes and no delays.

Step 4: Video Meeting with the Notary

After approval, you receive an SMS for a short video call with the Notary (Botim or Zoom). During the call, the Notary will:

  • Check your identity
  • Confirm you are giving the powers willingly
  • Explain the POA so you fully understand it

We guide you before and during the call to make the process smooth.

Step 5: Digital Signature and Payment of Fees

After your identity and understanding are confirmed, you will get a message on your phone or in the UAE Pass app asking you to sign (to apply your electronic signature). Once you sign, you can pay the government fees online.
Our team handles everything so the process is fast and easy for you.

Step 6: Issuance of the Final Power of Attorney

After you pay, the system creates your digital POA right away. You will get the final document by email as a safe PDF. It includes:

  • A special serial number
  • A QR code you can check
  • No red stamp — the new digital version is fully official and can be shared with any government office, bank, or other authority.

Legal Validity and Recognition of Getting POA in UAE

A properly notarised Power of Attorney in Dubai is accepted by many official authorities. It is legally recognised by:

  • Dubai Courts and all UAE Federal Courts.
  • The Dubai Land Department (DLD) and RERA,
  • The Department of Economic Development (DED) and all free zone authorities,
  • UAE banks and financial institutions, and
  • Federal bodies such as the Ministry of Interior and the Ministry of Justice.

A Power of Attorney issued in the UAE can also be used in other countries after it receives MOFA attestation and, if needed, an apostille. This is often required by expats and international investors who handle matters in more than one country.

Misusing a Power of Attorney in the UAE is a serious crime. It can be treated as a breach of trust or fraud, and the person responsible can face both civil and criminal charges.

Why You Need a Lawyer to Draft Your POA in Dubai?

Many people use standard wat to draft Power of Attorney templates they find on the internet. This is a big mistake. A badly written Power of Attorney can cause many problems.

  • Rejection: If the words are not exactly what a bank or government office wants, they can refuse it and say no.
  • Legal risk: If the powers are too wide or not clear, the agent might by mistake or on purpose cause money loss or other damage.
  • Translation errors: In the UAE, the Arabic text is what the court reads and follows. If the translation from English to Arabic is wrong, the legal meaning of the Power of Attorney can change.

FAQ’s

1. Does Dubai have any law that a Power of Attorney is legally valid without being notarized?

No. Power of Attorney, as it is, may be considered as a legally valid document in Dubai and the UAE, but it must be notarized by an authorized UAE Notary Public or an approved online notarization system. In 2026, this includes the Dubai Courts e-Notary and the Ministry of Justice (MOJ) digital portals, which provide a blockchain-hashed digital original.

2. Is it possible to write a Power of Attorney in English only?

No. To use in UAE, a Power of Attorney should be written in Arabic or made a bilingual document in Arabic and English. A certified legal Arabic translation is required in case it is prepared in a different language. However, the Abu Dhabi Judicial Department (ADJD) now offers a specialized English Language Notary Bureau for specific cases, though bilingual remains the standard for nationwide use.

3. What is the distinction between a General and Special power of attorney?

A General Power of Attorney gives the holder a range of powers that can control various issues, whereas a Special Power of Attorney confines the power of the person to certain actions like property sale, court representation or a transaction involving a specific item. In 2026, most banks and the DLD strictly require a Special POA for high-value transactions to mitigate fraud risks.

4. Is it possible to issue a Power of Attorney outside of the UAE?

Yes. An international Power of Attorney should be notarized in the country of issue and attested by the local Ministry of Foreign Affairs before legalization by the UAE Embassy or Consulate and attested by UAE MOFA and translated into Arabic to be used in the UAE. As of 2026, many countries’ residents can also use Remote Online Notarization (RON) via the UAE Ministry of Justice if they have a verified UAE PASS.

5. Does notarization in Dubai require the presence of the parties?

In most cases, yes. The principle should stand before the notary. Nonetheless, there are options of online notarization via UAE Ministry of Justice and Dubai Courts e-Notary systems to eligible cases. In 2026, “presence” is legally satisfied by a recorded video call with a licensed notary, provided the principal undergoes biometric verification via the UAE PASS app.

6. Is power of attorney revokeable in the UAE?

Yes. A Power of Attorney may be terminated any time by a formal revocation paper notarized in the UAE and then an agent and authorities notified. In 2026, you can initiate a Digital Revocation through the Ministry of Justice portal, which instantly updates the document’s status in the national blockchain registry.

7. Preparation and notarization of a Power of Attorney: How long does it take?

The drafting and notarization phase will normally take one working day, given that all documents are present. Depending on the jurisdiction, attestation of foreign-issued POAs can also require a few more days. Digital notarization for UAE residents with a “Green” status UAE PASS can often be completed in under 30 minutes.

8. Is a Power of Attorney applicable in the sale of property in Dubai?

Yes, as long as the Power of Attorney is specifically mandated to sell the property and is recognized by the Dubai Land Department. General POAs tend to be rejected on property transactions. Under the 2025 DLD Circular, a property sale POA must expressly mention the Title Deed number and is typically valid for only two years from the date of notarization.

9. Is a Power of Attorney indefinite?

A Power of Attorney takes place until it is revoked or until its validity period lapses. Certain authorities might set some conditions of recent POAs based on the transaction. For example, in 2026, the RTA and many banks will not accept a POA that is more than two years old for specific high-risk actions, even if the document itself has no expiry date.

10. Are all Powers of Attorney acceptable in banks and courts?

Only properly drafted, notarized and purpose-specific Powers of Attorney are accepted by Banks, courts and government departments. Unclear or badly written POAs can be dismissed. Banks in 2026 have particularly strict Anti-Money Laundering (AML) requirements and often require their own specific wording to be included in the POA.
