What Is Construction Law in the UAE?

Construction law in the UAE sets out the rights and responsibilities of all parties involved in a construction or engineering project. This covers all employers, contractors, subcontractors, consultants, engineers, architects, and suppliers. 

The key legal framework includes:

  • Federal Law No. 5 of 1985 (Civil Transactions Law, as amended) covers the rules about contracts, obligations, liability, and damages (to be replaced by Federal Decree-Law No. 25 of 2025 effective 1 June 2026).

Cases usually begin at the Court of First Instance, and if someone is not happy with the decision, they can appeal up to the Court of Cassation. The Ten-Year Liability Rule for Construction Law Defects

The UAE law mandates a 10-year Structural Warranty, which construction professionals including contractors, architects, and engineers must follow as “Decennial Liability” .

Under the UAE Civil Code, all designers, architects, engineers, and contractors share responsibility to pay for all expenses resulting from building collapses and all costs needed to repair structural defects which endanger building safety and stability. 

Articles 880 to 883 of the UAE Civil Transactions Law establish legal rules for decennial liability, which enables employers, developers and purchasers to claim damages from contractors and constructors, engineers, architects for all building collapses and structural defects that compromise building safety and stability.  

The architect who does not oversee construction work but only provides building designs will face liability solely for defects related to their design work.

Even if:

  • the defect or collapse arises out of a defect in the land itself or 
  • the employer (property owner or client)  consented to the construction of the defective buildings or installations.

The period of ten years shall commence as from the time of delivery of the work to the property owner (employer).
