Case Study: AED 50 Million Cross-Border Asset Recovery
The Challenge
In what turned out to be one of the most complicated cases that I have ever handled, an international investment firm sought my help after its partner absconded from the UAE after misappropriating company assets worth more than AED 50 million. In this case, there was a need to consider various jurisdictions, as the fraudster had moved the stolen assets via several different financial avenues.
Strategic Approach
Firstly, I started legal proceedings against the individual on a charge of breach of trust and, at the same time, filed for a suit to seek a precautionary attachment on the rest of the assets located within the UAE.
With the help of a team of forensic finance specialists, we managed to trace the transaction process and identify the mechanism used to camouflage the transaction.
The Result
After a series of legal arguments, the court ordered the freezing of the defendant’s assets in the UAE. In less than 14 months, almost 90% of the money was recovered in favour of my client through a court-approved settlement.
